Application for Membership
MEMBERSHIP AND ADVISORY AGREEMENT FOR THE TRADER'S COUNTRY
CLUB
This stock and commodity advisory and subscription agreement
is made and entered into on the date the member receives his private log in
and password from Commodity Advisors of the Woodlands LLC (CA of the W) for
membership to the Trader's Country Club for the membership level requested.
Advisory Signals are only Recommendations
The member agrees that CA of the W is not: (a) managing the
account of the member, (b) entering orders for specific trades for the member,
(c) advising the member as to how to manage his own funds and (d) specifically
guiding the member as to all the trades that the member may choose to place
for his account. The member also acknowledges that, since the member receives
knowledge and advice from many sources, he may place trades in his own personal
account based upon the member's own trading decisions. CA of the W has no
knowledge what actual trades are placed by the member. CA of the W posts its
technical trading signals and recommendations solely as a possible trade and
risk that the member may consider as part of all the deliberations that the
member must make for his own account. The member also acknowledges that all
reported buy or sell price levels for any recommended position by our services
are entirely hypothetical and do not represent any results from an actual
account.
There is risk of serious losses when trading
stocks or commodities
The member acknowledges that he/she
has fully read and understands the RISK DISCLOSURE at the TradersCountryClub.com
web site and that they are fully aware of the many inherent limitations of
the presentation of historical hypothetical performance or results of past
performance. The member agrees and hereby states that there has been no oral
or written statements made by CA of the W, or either its owner, John Sheely,
or any employee of CA of the W, that in any way diminishes the risks inherent
in trading stocks or commodities. The member acknowledges that trading losses
may occur and that such losses are solely the responsibility of the member
and that CA of the W or John Sheely is in no way liable to the member for
any trading losses that may occur.
The member understands that the information and trade recommendations
contained in all of the content of the Trader's Country Club is a valuable asset
to CA of the W and that CA of the W must control its distribution to stop unauthorized
access to its services. In order to protect CA of the W from unauthorized access
by individuals or entities who are not paid members, CA of the W shall have
the right to monitor any and all advisory log in or downloads from Traderscountryclub.com
to determine the frequency a member may access its advisory services and other
content. In the event that, in the sole opinion of CA of the W, the member's
personal Password and User ID is used too frequently for the probable sole use
of the member, CA of the W may cancel member's subscription and forward a prorated
refund.
In the event the Trader's Country Club is unable to post recommendations
due to vacation time, sickness or health of the advisor John Sheely, each
member will receive a credit for an equal amount of days for which service
was not posted or unavailable. CA of the W is not responsible for electrical,
telephone, server, Internet or any other kind of mechanical problems that
may arise in the distribution of its advisory services through the use of
the Internet, e-mail, cable or telephone system. In the event of any problem
in the distribution of its advisory services, CA of the W will use its best
efforts to make its recommendations fully assessable to all its members through
whatever means feasible.
The Trader's Country Club issues many trade recommendations
each and every day. Because of the frequency of trading, the cost of commissions
and fees can be extremely high, depending on which recommendations are followed
by each member. Each member is encouraged to negotiate brokerage commissions
that are appropriate to the size of the member's account, the frequency of
trading and the amount of assistance that any broker is requested to provide
to their clients.
It is highly recommended that members have
a fast and reliable internet connection. The audio and video format used for
our advisory services and course content are large files and are streamed
over the internet. Before joining the Traders Country
Club, go to the Trading Courses Tour of Services link on the left hand side
of the home page and play the flash file examples for our advisory services
and courses. If these files do not run or play slowly, it is recommended that
you do not join at this time. If you have adequate speed for the Internet
and these files will not play, contact a computer professional to ascertain
why you are unable to play the flash files properly. The Traders Country Club
does not have technical personnel and we will be unable to solve these issues
for current or potential members.
Payment Policy
Upon payment permitted on the following page for selection
of membership categories, the new member will receive a temporary username
and password into the site. The Traders Country Club will send each member
new log-in information selected by CA of the W. The new username and password
is normally sent within 24 hours upon our receipt of notice that a new member
has joined the club. Members should take care in writing this information
down and keeping the information private.
Membership is not automatically renewed at the end of
your membership period. At the conclusion of a member's membership period,
Commodity Advisors of the Woodlands will not bill a members credit card. All
memberships require that a member affirmatively renew his membership by access
through this portal.

This agreement shall be deemed to have
been made and construed under the laws of the State of Texas, which shall
have jurisdiction over any actions arising from this agreement. Member agrees
that any possible liability arising from this agreement on the part of CA
of the W or its owner, John Sheely, shall be limited to liquidated damages
in the amount of the member's subscription cost.
